Terms of Use

These conditions govern access to Polk County Criminal History. Visiting a page, reading its material, or using a search feature signals agreement with every term below. Anyone who does not agree must stop using the resource.

NO FCRA USE. This privately operated resource has no government affiliation. Neither it nor its advertising partners provides a service intended for credit, employment, tenant, insurance, or another Fair Credit Reporting Act purpose. Its role is to identify official criminal-record channels in Polk County and Georgia. It is not a private investigation firm or consumer reporting agency.

1. What This Website Is

This is a private reference site, operated independently from government. It neither stores official records nor retrieves records, conducts official checks, or files documents for a visitor.

Its material routes readers to the Polk County Sheriff, criminal courts, the Georgia Bureau of Investigation and GCIC, and the Georgia Sex Offender Registry. Some pages also connect to outside tools that may assist personal research.

2. Rules for Using This Site

Use is permitted only if the visitor agrees not to:

  • Violate a local, Georgia, or federal law through use of the resource
  • Harass, threaten, or stalk a person with information found here
  • Use the content for a credit, employment, housing, or insurance decision
  • Attempt unauthorized access to a page, account, server, or system
  • Deploy a bot, scraper, or other automated collection tool
  • Interfere with performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

Information found here or through a linked service may not be used to harass, stalk, intimidate, threaten, or discriminate. Misuse may violate the law. Georgia Sex Offender Registry information exists for public-safety awareness, not retaliation, vigilantism, prohibited screening, or discrimination against a listed person.

4. We Are Not a Consumer Reporting Agency

Polk County Criminal History is not a consumer reporting agency under the FCRA and produces no consumer, credit, or background report. Its data and linked tools may not be used to:

  • Make a hiring, firing, or other employment decision
  • Evaluate a renter, tenant, or housing applicant
  • Set insurance terms or assess creditworthiness
  • Determine access to a license, permit, or government benefit
  • Carry out any additional purpose regulated by the FCRA

Any legally required screening must use the proper official or FCRA-compliant channel, not information from this resource.

5. No Legal Advice

The material is not legal advice. General explanations of Polk County records cannot determine how a charge, conviction, warrant, or Georgia record restriction law applies to a particular person. Consult a licensed Georgia attorney for that advice.

6. No Warranties

All content and services are supplied "as is," without a promise that:

  • Information will always be complete, accurate, and current
  • Access will remain continuous or uninterrupted
  • Every page will be free from errors or security flaws
  • An outside search result will be correct or comprehensive

Criminal records change as charges are filed, dismissed, restricted, sealed, or corrected. Delays and gaps can occur. No statement here is an official declaration by a court, sheriff, or government agency.

7. Third-Party Services and Links

Links lead to sheriff pages, court portals, Georgia agencies, legal-aid resources, and outside search services. We do not control their content, privacy practices, pricing, accuracy, or availability. Their own terms govern use after a visitor leaves this resource.

8. Intellectual Property

Text, graphics, logos, and code belong to Polk County Criminal History or its content partners. Copying, distributing, modifying, or creating derivative material requires prior written permission.

9. Limits on Our Liability

To the maximum extent allowed by law, we are not liable for damage arising from use of the resource, its information, or a linked service.

10. Indemnification

A visitor agrees to indemnify and hold us harmless from claims, demands, or proceedings caused by that visitor's use or breach of these terms, including related legal fees and costs.

11. Governing Law

Georgia law governs these terms, including applicable principles under the Georgia Fair Business Practices Act, O.C.G.A. § 10-1-390 et seq. Any dispute tied to use must be brought in a court with proper jurisdiction in Georgia.

12. Changes to These Terms

These terms may be revised. A replacement becomes effective when it is posted on this page.

13. Cutting Off Access

Access may be restricted or ended at any time, for any reason, without advance notice.

14. Severability

If one provision is held invalid or unenforceable, the remaining terms continue. The affected provision will be limited only as much as needed to make it enforceable.

15. Questions

Questions about these conditions may be directed through the Contact page.
